What is surprising is how quiet the usually garrulous Awolokans have become, they're not even preaching patience anymore as their man routinely elects to live it up at the dire expense of the dying country – a Royal Yacht [one sank recently off Sicily] an American Beast like Joe Biden's, and a deluxe Air Monster like the King of Saudi's. Of course, Tinubu is working hard in Paris to bring good governance to Nigeria, while China is scouting around for more Nigerian assets to seize or plunder.

They cannot overlook the challenges of nation building which throws up sometimes the sort of official incompetence they are trying to capitalise on in this case. Many years after this case they want to look back and argue that they handled the matter with maturity and helped Nigeria take the right decisions.

It is important to clarify that the Arbitration Tribunal did not find the Federal Republic of Nigeria (FRN) liable for the breach of the Ogun/Chinese contract by Ogun State. The tribunal found the Federal Republic of Nigeria liable for breaching the Federal Republic of Nigeria (FRN) Bilateral Investment Treaty (BIT) with the Peoples Republic of China (PRC). On account of the conduct of the agencies of the FRN (Nigerian Police and Nigerian Export Processing Zone Authority)

Article (2), (3) and (4) of FRN and PRC Bilateral Investment Treaty (BIT) mandates that Nigeria and China must protect, and not cause harm, to the investments of each other in Nigeria and China. And they must treat their respective investors fairly. Subject to their laws.

So, the Arbitration Tribunal found that Nigeria breached their BIT with China when — after Ogun State cancelled the contract — Nigeria (Nigerian agencies) treated the Chinese investors unfairly, "in 2016", by:

1. The Nigerian Export Processing Zone Authority asking Nigerian immigration to cancel the work permit of the Chinese investors to prevent them from doing business in Nigeria;

2. The Nigerian police issuing a warrant of arrest for the Chinese investors (Dr. Han and Mr. Zhao);

3. The Nigerian police arresting the Chinese investor (Mr Zhao), at gun point, denying him food and water, and detaining him for 10 days. Without due process

In fact, United States Court of Appeal for the District of Columbia (during the sovereign immunity aspect of the case) in citing the case of Abia v. A.G. Federation (16 NWLR, Part 1005, Page 265) was explicit: "State and Federal Governments in Nigeria are autonomous and thus free from the direction of one another"

The United States Court of Appeal for the District of Columbia also stated that the Arbitration Tribunal: "did not attribute Ogun State's breach of contract to Nigeria"

The bottom line is that if the Nigerian Export Processing Zones Authority (NEPZA) and the Nigerian Police (agencies of the Federal Republic of Nigeria) had not intervened — in 2016 — the Arbitration Tribunal would not have found that Nigeria breached their BIT with China
